On December 27, the 5th Circuit Court vacated the motion to stay the injunction on BOI reporting. As a result, the Financial Crimes Enforcement Network (FinCEN) is currently unable to enforce the reporting requirements. It remains uncertain whether filing will continue to be voluntary or if further delays beyond January 13 will be announced.
We recommend that anyone subject to the BOI reporting requirements continue gathering the necessary information and remain prepared to file the BOI report should the injunction be lifted again.
